1. Introduction and Acceptance
Welcome to Marlo, a self-hosted and hosted AI marketing automation tool (Marlo, an mlforge Studio product). By accessing or using the Marlo service—including any website, application, documentation, or other material provided by us—you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these terms, please do not use our services.
These Terms apply to all users, including administrators and end-users who interact with the Marlo platform. We reserve the right to modify these Terms at any time; changes will take effect immediately upon posting on this page. Continued use of the service after such modifications constitutes acceptance of the new terms.
2. Description of Services
Marlo provides AI-powered marketing automation tools that run AI agents for tasks including SEO, GEO, content generation, social media drafts, GitHub pull request (PR) drafting, lead search, and email outreach. All outputs generated by Marlo are drafts intended for human review. Nothing auto-publishes or auto-sends without explicit user action. The only exception is that email replies always require your approval before sending; Marlo will never send an email on your behalf unless you explicitly approve it in the interface.
Marlo offers three distinct service models:
1. Self-Hosted (Free) — AGPL-3.0 licensed; user runs their own infrastructure and brings their own API keys; no warranty since it’s self-hosted open source.
2. Hosted with Built-in AI Models ($29/mo) — Marlo hosts the application and includes built-in AI models for inference.
3. Hosted Bring-Your-Own-Key ($9/mo) — Marlo hosts the application, but you pay your own LLM provider directly; Marlo does not incur model costs on your behalf.
3. Self-Hosted Plan Terms
The self-hosted version of Marlo is distributed under the GNU Affero General Public License version 3 (AGPL-3.0). By using or modifying the self-hosted code, you agree to comply with the AGPL-3.0 license terms as published by the Free Software Foundation. This includes obligations regarding source code availability and derivative works.
Because this is open-source software that you run on your own infrastructure:
- You are solely responsible for securing, maintaining, and backing up your deployment.
- Marlo provides no warranty, support, or liability coverage for self-hosted instances.
- Any issues arising from your configuration, environment, or third-party dependencies are your responsibility.
4. Hosted Plan Terms
4.1 Subscription Fees and Billing
Hosted plans are billed on a monthly recurring basis:
- Hosted with Built-in AI Models: $29 per month.
- Hosted Bring-Your-Own-Key: $9 per month (you pay your own LLM provider directly).
All fees are non-refundable for partial months. If you cancel mid-cycle, any unused portion of the current billing period is forfeited.
4.2 Payment and Taxes
You agree to provide valid payment information and to keep it up to date. You are responsible for all applicable taxes except those expressly collected by Marlo (e.g., sales tax where required by law).
4.3 Service Availability
Marlo strives to maintain high availability, but we do not guarantee uninterrupted access or performance. We may suspend or terminate service temporarily if necessary for maintenance, security, or abuse mitigation.
5. User Responsibilities and Third-Party Services
You are responsible for complying with the terms of any third-party service you connect to Marlo (e.g., Gmail, GitHub, Google Analytics). Marlo does not assume liability for actions taken by those services or for data transmitted through them. You must ensure that your use of connected services complies with their respective terms and applicable laws.
6. Content Ownership and Intellectual Property
- User Content: Any content you create, upload, or generate within Marlo (including drafts, notes, and exports) remains your property.
- Marlo’s IP: The Marlo software, codebase, branding, documentation, and underlying AI models are owned by mlforge Studio unless otherwise stated in the AGPL-3.0 license for self-hosted versions.
7. Limitations of Liability
To the fullest extent permitted by law, Marlo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or business opportunities, even if advised of the possibility of such damages. Our total liability under these Terms is limited to the amount you paid us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless mlforge Studio and its affiliates from any claims, losses, liabilities, damages, or expenses (including legal fees) arising out of your use of Marlo, including but not limited to breaches of these Terms, misuse of the service, or violations of third-party rights.
9. Termination and Suspension
We may suspend or terminate your access to any or all features of Marlo at our sole discretion, with or without notice, for reasons including (but not limited to) suspected abuse, violation of these Terms, or technical issues. Upon termination:
- You must stop using the service immediately.
- Any unpaid balances become due and payable.
- We may delete your data in accordance with applicable law and our privacy policy.
10. Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising under or relating to these Terms will first be attempted to be resolved informally by contacting us at legal@marlo.dev. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts having competent authority.
